1. Acceptance of Terms
By accessing or using Real-Eye.in ("Real-Eye", "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. Real-Eye is owned and operated by Trivance Technologies LLP, a limited liability partnership registered in India. These Terms constitute a legally binding agreement between you and Trivance Technologies LLP.
2. Description of Service
Real-Eye is an image intelligence platform that provides three core capabilities:
Analyze: Forensic image analysis including AI-generated image detection, deepfake detection, steganography detection, metadata extraction, and 101+ forensic checks (error level analysis, frequency analysis, noise profiling, and more).
Search: Reverse image search across the public web using third-party search APIs to find where an image appears online, including face-based matching.
Report: Takedown report generation that compiles forensic evidence, search results, and platform-specific removal instructions into actionable documents.
The Service provides indicative analysis results and informational tools only. It does not constitute legal, forensic, or expert evidence, and does not provide legal advice.
3. Eligibility
You must be at least 18 years of age to use Real-Eye. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
4. Account and Authentication
Access to Real-Eye requires authentication via Google OAuth. You are responsible for maintaining the security of your Google account. You must not share your session or allow others to access Real-Eye through your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate any account at our sole discretion.
5. User Obligations and Responsibilities
By using Real-Eye, you agree to the following:
5.1 Image Ownership: You will only upload images that you own, or for which you have explicit written authorization from the owner to analyze or search. You are solely responsible for ensuring you have the legal right to upload and process any image.
5.2 Lawful Use: You will not use Real-Eye for any unlawful purpose, including but not limited to: harassment, stalking, defamation, invasion of privacy, distribution of illegal content, or circumventing any law.
5.3 Prohibited Content: You must not upload images containing: child sexual abuse material (CSAM), content depicting violence against minors, content that violates the Indian Penal Code or Information Technology Act, 2000, or content that is obscene under applicable law.
5.4 No Abuse of Service: You must not attempt to reverse-engineer, overload, or compromise the Service. Automated bulk uploads, scraping, or API abuse is prohibited without prior written authorization.
5.5 Accurate Information: You agree not to provide false or misleading information when using the Service.
5.6 Responsible Use of Results: You must not misrepresent Real-Eye results as certified forensic evidence, legal proof, or expert testimony. You are solely responsible for any actions you take based on analysis results, search results, or takedown reports generated by the Service.
6. Analysis Results and Disclaimer
IMPORTANT: Real-Eye results are INDICATIVE and NOT definitive.
The forensic analysis provided by Real-Eye is based on statistical and algorithmic methods that have inherent limitations. Results should be used as supporting information alongside professional judgment and other verification methods. Specifically:
Real-Eye does not guarantee the accuracy of AI detection scores. A "Likely Real" result does not certify that an image is authentic. A "Likely AI-Generated" result does not constitute proof that an image is artificially generated. Images shared through messaging platforms (WhatsApp, Telegram, etc.) may have metadata stripped, which affects analysis accuracy. Analysis results should not be used as sole evidence in legal proceedings without corroboration from qualified forensic experts.
7. Third-Party Services and Disclaimer
Real-Eye integrates with third-party services including but not limited to: Google Cloud Vision and TinEye (for reverse image search), AWS Rekognition and Claude Vision (for forensic analysis), and Razorpay (for payment processing).
Real-Eye does not control, guarantee, or assume responsibility for the accuracy, completeness, availability, or reliability of results returned by third-party services.
Search results reflect publicly available content indexed by third-party providers. We do not verify the accuracy or legality of content found through reverse image search. Each third-party service operates under its own terms of service and privacy policy. Third-party service availability may change without notice and Real-Eye is not liable for any service interruptions from these providers.
8. Takedown Reports
Takedown reports generated by Real-Eye are informational tools designed to assist users in requesting content removal from online platforms. Real-Eye does not:
Provide legal advice or legal representation. Guarantee that platforms will comply with removal requests. Submit takedown requests on your behalf. Verify whether you have legal standing to request content removal.
You are solely responsible for verifying your legal rights and the accuracy of information before submitting any takedown request to a platform. Real-Eye recommends consulting a qualified legal professional for matters involving intellectual property, defamation, or non-consensual intimate images.
9. Credits and Payments
Real-Eye operates on a credit-based system. Free credits may be provided periodically, and additional credits can be purchased via Razorpay (UPI, card, or netbanking). Credits are consumed when using the Analyze, Search, or Report modules. Credit costs per module are configurable and displayed before each action.
Credits are non-refundable once purchased, except where required by applicable consumer protection laws. Purchased credits do not expire under normal operation. However, in the event of service discontinuation, shutdown, or permanent suspension of Real-Eye, all unused credits shall be forfeited. Real-Eye will provide a minimum of 30 days advance notice before any planned shutdown, during which users may utilize their remaining credits. No refunds will be issued for unused credits upon service termination.
We reserve the right to modify pricing, credit costs, and free tier limits at any time with reasonable notice. Payment processing is handled by Razorpay — we do not store your card numbers, UPI IDs, or banking credentials.
10. Intellectual Property
Our IP: The Real-Eye platform, its code, design, algorithms, forensic analysis methods, branding, and all associated intellectual property are owned by Trivance Technologies LLP. You may not copy, modify, distribute, or create derivative works of the Service.
Your Content: You retain all rights to images you upload. By uploading an image, you grant us a limited, temporary license to process the image solely for the purpose of performing analysis or search. This license terminates immediately upon completion of processing. We do not claim any ownership over your images or content.
Reports: Forensic and takedown reports generated by Real-Eye are provided for your personal or authorized professional use. You may share reports with third parties (including platforms for takedown requests), but you may not represent Real-Eye output as certified forensic evidence without our written consent.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
Real-Eye is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
Real-Eye shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, reputation, or business opportunities, arising from: your use of the Service, reliance on analysis or search results, actions taken based on takedown reports, or the accuracy or availability of third-party service results.
The total aggregate liability of Real-Eye for any claims arising from your use of the Service shall not exceed the amount paid by you to Real-Eye in the 12 months preceding the claim, or INR 1,000, whichever is greater.
12. Indemnification
You agree to indemnify, defend, and hold harmless Real-Eye from and against any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: your use of the Service, your violation of these Terms, your violation of any law or third-party rights, images you upload, takedown requests you submit based on Real-Eye reports, or any action taken based on results provided by the Service.
13. Service Availability
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, server issues, third-party service outages, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice.
14. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Grounds for termination include: violation of these Terms, uploading prohibited content, abuse of the Service, fraudulent activity, or any conduct that we determine is harmful to the Service or other users. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall survive, including: limitation of liability, indemnification, and governing law.
15. Reporting and Compliance
If you encounter content that appears to be illegal (including CSAM), please report it immediately to hello@trivance.tech. We will cooperate with law enforcement agencies as required by Indian law, including the Information Technology Act, 2000 and the POCSO Act, 2012.
16. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated through a notice on our website or via email. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms. If you do not agree with changes, you must stop using the Service.
17. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of India, including the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023, the Indian Contract Act, 1872, and the Consumer Protection Act, 2019, as applicable. Any dispute arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts in Delhi, India.
18. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
